BookHaven sells books and related products as they are published. We do not create or control the content of the books we sell. The views expressed in the books we sell are those of the authors and do not necessarily reflect the views of BookHaven.

4. Orders and Payments

4.1 Order Acceptance

Your order through the Service constitutes an offer to purchase the products in your order. All orders are subject to acceptance by us. We may, at our sole discretion, refuse to accept an order for any reason, including but not limited to product unavailability, errors in pricing or product information, or identification of unusual ordering patterns.

4.2 Prices and Payment

All prices displayed on the Service are in British Pounds (£) and are inclusive of UK Value Added Tax (VAT) at the applicable rate, unless otherwise stated. Prices are subject to change without notice.

Payment can be made by credit or debit card, or other payment methods as indicated on the Service. By providing a payment method, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your payment method for the total amount of your order (including taxes and shipping charges).

Risk of loss and title for items purchased from our Service pass to you upon delivery of the items to the carrier.

By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media.

You represent and warrant that: (i) you own the User Content you submit or otherwise have the right to grant the license set forth above, and (ii) the User Content does not violate the privacy rights, publicity rights, copyright rights, or other rights of any person or entity.

9. Limitation of Liability

In no event shall BookHaven, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

Whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

You agree to defend, indemnify, and hold harmless BookHaven, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Service.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Dispute Resolution

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in London, United Kingdom, using the English language in accordance with the Arbitration Rules and Procedures of the United Kingdom then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes.

The prevailing party in any arbitration or other proceeding arising under these Terms shall be entitled to receive reimbursement of its reasonable expenses (including reasonable attorneys' fees, expert witness fees, and all other expenses) incurred in connection therewith.

Notwithstanding the foregoing, we may seek injunctive or other equitable relief to protect our intellectual property rights in any court of competent jurisdiction.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
